Legislation and court decisions are constantly changing the landscape in terms of environmental liability. Bill 133

Montague v. MOE

The Ontario Court of Appeal reinforced the MOE's to hold Officers and Directors of a company responsible for the clean up cost of a polluted site when the corporation does not have the resources to effect clean up.

ESSO v. The Quebec Ministry of Environment

The Supreme Court of Canada confirmed the "Polluter Pays" principal by forcing ESSO to pay the cost to clean up a property it disposed of in the early1970s.

Tridan v. Shell

A landmark case that significantly increased a polluter's obligation to clean up a neighbouring site.
